Homebuyers Privacy Protection Act

When a consumer applies for a mortgage, their personal data is sold—without their consent—to third-party entities that bombard them with unsolicited calls, texts, and emails. The Broker Action Coalition (BAC) is working alongside industry and consumer advocates to end this invasive practice once and for all.

What is reconciliation?

When the House and Senate pass slightly different versions of the same bill, they must agree on one final version before it can go to the President. This process is called reconciliation.

Bill Milestones:

  • On April 10, 2025, H.R. 2808 was introduced by Rep. John Rose (R-TN) and Rep. Ritchie Torres (D-NY).

  • On April 10, 2025, S. 1467 was introduced by Sen. Jack Reed (D-RI) and Sen. Bill Hagerty (R-TN).

  • On June 11, 2025, H.R. 2808 passed the House Financial Services Committee—with a unanimous 46-0 vote.

  • On June 12, 2025, S. 1467 was passed by the Senate by unanimous consent.

  • On June 23, 2025, H.R. 2808 was passed by the House.

Trigger Lead FAQs

  • Trigger leads are consumer data alerts sold by credit bureaus to lenders when someone applies for a mortgage. Once a credit check is pulled for a mortgage application, that information is flagged—and the consumer may be flooded with calls, texts, and emails from competing lenders.

  • Consumers don’t consent to their information being sold. Many are misled into thinking these calls are from their chosen lender or a government agency. This creates confusion, erodes trust, and exposes homebuyers to potentially predatory tactics at a vulnerable time.

  • Unfortunately, yes—under current federal law, credit bureaus can sell “prescreened” credit information for marketing purposes, including when someone applies for a mortgage. That’s why legislation is needed to change it.

  • The Homebuyers Privacy Protection Act (H.R. 2808 / S. 1467) prohibits the sale of mortgage-related trigger leads unless the consumer has given explicit permission or in carefully considered exceptions. It’s a major step toward putting consumers—not data brokers—in control of their personal financial information.
