BAC Applauds Landmark Passage of Trigger Lead Ban

Congress Bans Abusive Trigger Lead Practices After Mortgage Broker & Industry Push

WASHINGTON, D.C. (August 2, 2025) — The Broker Action Coalition (BAC) welcomes the passage of the Homebuyers Privacy Protection Act, bipartisan legislation that bans abusive trigger lead practices and limits the sale of consumer data without consent. With the Senate passing the House version on August 2, the bill has officially cleared Congress and now heads to the President’s desk. The BAC urges President Trump to sign the bill into law without delay.

The BAC extends its deepest thanks to the bill’s lead sponsors—Representatives John Rose (R-TN) and Ritchie Torres (D-NY), and Senators Bill Hagerty (R-TN) and Jack Reed (D-RI)—for championing this critical consumer protection.

The passage of this bill through Congress marks the culmination of a multi-year advocacy effort—driven by the BAC, its advocates, and coalition partners who united to limit the sale of trigger leads.

“The BAC was built to channel broker priorities into real policy wins. When we launched, we asked our earliest supporters to help set the agenda. The response was overwhelmingly clear: ending abusive trigger leads was our top priority. Today’s congressional action delivered on that,” said Brendan McKay, BAC Chief Advocacy Officer and Co-Founder. “This victory shows what’s possible when brokers get involved, stay organized, and invest in advocacy.”

Why Brokers Fought to End Trigger Leads

When a consumer applies for a mortgage and their credit is pulled, credit bureaus sell that data as “trigger leads”—including personal details like full name, contact information, and credit score range. Solicitors buy these leads and unleash a barrage of calls, texts, and emails, overwhelming homebuyers at a critical point in the process. All of this is done without the consumer's permission or proper disclosure. 

Some solicitors blur compliance boundaries, using deceptive language to imply connections with brokers or lenders. In addition to violating basic data privacy expectations, these tactics erode consumer trust and have been especially harmful to first-time homebuyers, non-native English speakers, and other vulnerable borrowers.

The Homebuyers Privacy Protection Act ends these abusive practices while preserving narrow exceptions for pre-existing relationships and giving consumers the power to opt in.

How Industry Collaboration & the BAC Made This Win Possible

The Trigger Lead Coalition, led by the Mortgage Bankers Association (MBA), united housing, financial services, and consumer advocacy organizations in support of this legislation. Members included the BAC, the National Association of Mortgage Brokers (NAMB), and other key industry groups. This rare alignment between industry and consumer voices sent a powerful message to lawmakers, reflecting a shared goal of protecting consumers and restoring trust in the homebuying process.

The BAC played a key role, combining direct advocacy on Capitol Hill with a coordinated grassroots campaign that included:

  • 250+ meetings with lawmakers and staff focused on this legislation

  • 25,000+ letters sent to Congress, sharing real-world stories from brokers and consumers that underscored the harm of abusive trigger leads

  • Two national Advocacy in Action fly-in events, each featuring a day of advocacy training followed by Capitol Hill meetings focused on this legislation, with nearly 400 attendees total

  • Tactical outreach to advocates in priority districts, including those represented on the House Financial Services Committee

“Our advocates didn’t just watch change happen from the sidelines—they made it happen,” said Rachel Clark, Executive Director of the BAC. “From letters and phone calls to face-to-face meetings on Capitol Hill, they turned grassroots momentum into real policy change.”

Driving Change: The Partners, Donors & Leaders Behind the Win

Advocacy at this level doesn’t happen alone. It takes investment, commitment, and shared belief in what’s possible.

These partners stood alongside brokers and homebuyers to champion stronger consumer protections and real industry change.

The BAC also thanks the individual donors whose contributions—especially from recurring monthly supporters—provide critical, sustained funding.

Finally, we recognize the BAC’s leadership—Board Members, Board Advisors, Council Chairs (including Federal Government Affairs Council Chair Jerry Robinson), Regional Captains, and State Captains—who dedicate their time and energy to driving this mission forward. We also thank the hundreds of Advocacy in Action attendees who traveled to Washington, D.C., on their own dime, to meet directly with lawmakers and advocate for change.

Continued Commitment to Homebuyer & Broker Interests

“This is a major win—but it’s just the beginning,” McKay added. “If you want more of this kind of progress, brokers need to keep showing up—and start funding the fight.”

At the federal level, tier 1 priorities include Third-Party Originated (TPO) surcharge, CFPB reform/Loan Originator Compensation (LO Comp), broker/lender relations guidance, and expanding access to disclosures in multiple languages. 

At the state level, tier 1 priorities include Disabled Veteran Property Tax Exemptions, Texas Cash Out Reform, improving access to Down Payment Assistance (DPA) programs, and strengthening partnerships with state associations.

“We’ve proven that when brokers get behind an issue, real change is possible,” McKay said. “Now it’s time to keep that momentum going—and take on what’s next.”
